This Privacy Policy explains how Make West, LLC d/b/a Wallflower Goods ("Wallflower Goods," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit wallflower-goods.com and any related pages or online stores we operate (collectively, the "Site"), when you place an order with us, and when you otherwise communicate with us. Please read it carefully. By using the Site, you acknowledge that you have read and understand this Privacy Policy.

1. Who We Are and How to Reach Us

Make West, LLC d/b/a Wallflower Goods, a Colorado limited liability company, is responsible for the personal information described in this Privacy Policy.

2. Personal Information We Collect

a. Information you give us

We collect the information you provide when you place an order, create an account, sign up for emails or text messages, request a sample or a custom color or scale, submit a review or photo, or contact us. This may include:

  • Name, billing address, shipping address, email address, and telephone number;
  • Order details, including the patterns, colors, scales, materials, and quantities you select, and any project or installation details you share with us;
  • Account login credentials, if you create an account;
  • The content of messages, reviews, ratings, photographs, and other materials you submit to us or post on the Site; and
  • Marketing preferences and consents.

b. Payment information

Payments are processed by our e-commerce platform, Shopify, and its payment processors. When you pay for an order, your payment card number and related payment credentials are collected and processed directly by those providers under their own security standards. We do not store full payment card numbers on our systems. We do receive limited transaction information, such as the last four digits of the card, the card brand, the billing address, and whether the transaction was approved.

c. Information collected automatically

When you visit the Site, we and our service providers automatically collect certain information about your device and your use of the Site, including your IP address, device and browser type, operating system, referring and exit pages, the pages and products you view, search terms, the dates and times of your visits, and similar usage data. We collect this information using cookies, pixels, tags, software development kits, and similar technologies, as described in Section 4.

d. Information from third parties

We may receive information about you from our e-commerce platform and hosting provider, our print and fulfillment partners, shipping carriers, payment processors, fraud-prevention providers, marketing and analytics providers, advertising platforms, and social media platforms when you interact with our pages or advertisements.

3. How We Use Personal Information

We use personal information for the following purposes:

  • Fulfilling orders. To process, print, produce, ship, and deliver your order; to process payments; to confirm and update you on order status; and to handle cancellations, damage claims, and other order issues.
  • Customer service. To respond to your questions, provide product and installation information, and manage our relationship with you.
  • Marketing. To send you emails and, where you have consented, text messages about our products, promotions, and new collections; to show you advertisements on other websites and platforms; and to measure how our marketing performs. See Sections 5 and 6.
  • Operating and improving the Site. To host and maintain the Site, understand how it is used, develop new products and features, and improve your shopping experience.
  • Security and fraud prevention. To detect, investigate, and prevent fraudulent transactions, abuse, and other unlawful activity, and to protect the rights, property, and safety of Wallflower Goods, our customers, and others.
  • Legal compliance. To comply with applicable laws, regulations, and legal process, to enforce our Terms of Use, and to establish, exercise, or defend legal claims.

4. Cookies and Similar Technologies

We use cookies and similar technologies that are necessary to operate the Site (for example, to keep items in your cart and to keep you signed in), as well as analytics and advertising cookies that help us understand Site traffic and deliver relevant advertising. Most web browsers allow you to block or delete cookies through your browser settings. If you block cookies that are necessary for the Site to function, parts of the Site may not work properly.

Do Not Track and opt-out preference signals

Some browsers transmit "Do Not Track" signals. Because no common industry standard for Do Not Track has been adopted, the Site does not currently respond to Do Not Track browser signals. Where required by applicable law, we honor recognized universal opt-out preference signals, such as Global Privacy Control (GPC), as a request to opt out of targeted advertising and the sale or sharing of personal information from the browser that transmits the signal.

5. Analytics and Advertising

We work with analytics and advertising providers, which may include Shopify, Google, Meta (Facebook and Instagram), Pinterest, and similar platforms. These providers use cookies, pixels, and similar technologies on the Site to collect information about your browsing activity over time and across websites and applications, in order to measure our marketing and to show you advertisements for our products.

We do not sell your personal information for money. However, the use of advertising and analytics technologies described above may be considered a "sale" or "sharing" of personal information, or "targeted advertising" or "cross-context behavioral advertising," under certain state privacy laws. You may opt out of this activity at any time by using the "Your Privacy Choices" or "Do Not Sell or Share My Personal Information" link on the Site, by transmitting a recognized opt-out preference signal such as GPC, or by contacting us at hello@wallflower-goods.com.

You may also learn about your choices for interest-based advertising at optout.aboutads.info (Digital Advertising Alliance) and youronlinechoices.eu, and you may control certain Google analytics and advertising features at adssettings.google.com.

6. Email and Text Message Marketing

Email

If you subscribe to our emails or place an order, we may send you marketing emails. You may opt out at any time by clicking the "unsubscribe" link in any marketing email or by contacting us at hello@wallflower-goods.com. We will continue to send you transactional messages about your orders, such as order confirmations, shipping notices, and responses to your inquiries, even if you opt out of marketing email.

Text messages

If you provide your mobile number and consent to receive text messages from us, we may send you recurring marketing and order-related text messages, which may be sent using an automatic telephone dialing system. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any message, and you may reply HELP for assistance. We honor opt-out requests promptly and in any event within the time required by applicable law. Carriers are not liable for delayed or undelivered messages.

7. How We Disclose Personal Information

We disclose personal information in the following circumstances:

  • Service providers. To vendors that perform services for us, including our e-commerce platform and website host, printing and fulfillment partners, shipping carriers, payment processors, email and text message platforms, customer service tools, analytics providers, and IT and security providers. These vendors are permitted to use the information only to provide services to us.
  • Advertising and analytics partners. As described in Section 5.
  • Professional advisors. To our attorneys, accountants, insurers, and similar advisors.
  • Legal and safety. When we believe disclosure is required by law or legal process, or is reasonably necessary to enforce our agreements, investigate suspected fraud or other unlawful activity, or protect the rights, property, or safety of Wallflower Goods, our customers, or others.
  • Business transfers. In connection with a merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction, or during due diligence for such a transaction.
  • With your direction. At your request or with your consent.

We do not disclose your personal information to third parties for those third parties’ own direct marketing purposes.

8. Your Choices and Privacy Rights

You may update your account information at any time by logging in to your account, and you may opt out of marketing communications as described in Section 6.

Depending on where you live, you may have some or all of the following rights with respect to your personal information:

  • To confirm whether we process your personal information and to access that information;
  • To correct inaccuracies in your personal information;
  • To request deletion of your personal information;
  • To obtain a portable copy of personal information you provided to us;
  • To opt out of targeted advertising and the sale or sharing of personal information; and
  • To be free from unlawful discrimination for exercising these rights.

To submit a request, email us at hello@wallflower-goods.com with "Privacy Request" in the subject line, or write to us at the address in Section 1. We will verify your request by asking for information that matches what we already have on file, such as the email address or order number associated with your purchases. You may use an authorized agent to submit a request on your behalf, and we may ask the agent for proof of your authorization. We will respond within the time required by applicable law. If we decline your request, you may appeal our decision by replying to our response, and we will inform you in writing of the outcome of the appeal and of your right to contact your state attorney general.

Additional state disclosures

California. California residents may request information about our disclosure of personal information to third parties for those third parties’ direct marketing purposes under California Civil Code § 1798.83. As stated above, we do not make such disclosures.

Nevada. Nevada residents may submit a verified request that we not sell certain covered information by emailing hello@wallflower-goods.com. We do not currently sell covered information as defined by Nevada law.

9. Children’s Privacy

The Site is intended for adults and is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at hello@wallflower-goods.com and we will delete it. We do not knowingly sell or share the personal information of consumers under 16 for targeted advertising.

10. Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, and we rely on our e-commerce platform and payment processors to secure payment transactions. No method of transmission or storage is completely secure, however, and we cannot guarantee the absolute security of your information. Please protect your account credentials and notify us promptly if you believe your account has been compromised.

11. Retention

We retain personal information for as long as needed for the purposes described in this Privacy Policy, including to fulfill and support your orders, maintain business and financial records, resolve disputes, and comply with our legal obligations. Retention periods vary based on the type of information and the purpose for which it is held.

12. Third-Party Links and Content

The Site may contain links to third-party websites, plug-ins, and services that we do not control. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party site you visit.

13. Users Located Outside the United States

The Site is operated in the United States and is intended for users located in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your country.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above and post the revised policy on the Site. If we make material changes, we will provide additional notice as required by applicable law, such as by email or by a notice on the Site. Your continued use of the Site after the revised policy is posted constitutes your acceptance of it.
